WEBSITE HOSTING TERMS & CONDITIONS

Cancellation Policy
Clients are free to terminate hosting services at any time. Annually billed client refunds will be based upon actual amount of time that files are located on our servers. For example, if the annually paid client notifies us in the sixth month of hosting that they wish to terminate their yearly hosting, the client would be due a refund of six months hosting and are responsible for removing files from our servers before the end of their paid term, at which time we will delete the account. Monthly and quarterly billed clients will not receive credit or refunds and are again soley responsible for removing their data from our servers before their account expires, failure to do so will incur charges at the non-discounted monthly rates.

Exceeding Bandwidth and/or Disk Space
It is not possible to exceed your alloted diskspace or bandwidth. Accounts that have reached their diskspace capacity are disabled from accepting further files/email automatically and accounts reaching their bandwidth quota are disabled automatically. It is the customer's responsibility to monitor usage and upgrade when necessary to keep their account fully functioning. We reserve the right to suspend the account until the start of the next bandwidth allocation, suspend the account until more bandwidth is purchased at an additional fee or suspend the account until you upgrade to a higher level of package.

Invoices & Payments
Invoices will be generated at least two weeks prior to hosting renewal. Payment is due within two weeks of invoicing. We reserve the right to charge a 10% late fee if payment is not received within three weeks of invoicing. We will suspend hosting accounts where payment is thirty days or more past due unless prior arrangements are made and annual payment discounts will not be valid on overdue accounts, these will be charged at the monthly rate.

Technical Support
Technical support is available via the helpdesk and in some instances by phone. We strive to answer requests within 24 hours.

Client Content
The client agrees that they will not distribute, electronically transmit or display any materials in connection with client's use of these hosting services which: violate local or foreign laws or regulations; infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights); are defamatory, slanderous or trade libellous; are threatening or harassing; are discriminatory based on sexuality, gender, race, age or promotes hate.

The client agrees not to send malicious e-mails which contain viruses or other computer programming defects which result in damage to our servers or any third party. If Web Threads is notified of any infringement, we reserve the right to remove the offending content and/or suspend your account whilst an investigation is undertaken. If we find that an infringement was undertaken wilfully, we reserve the right to terminate your account with no refund.

No Spam Policy
Client shall not use the supplied hosting services for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Client also shall not engage in any unsolicited email practices that mentions or reference any domain hosted by Web Threads. Violation of this policy is seen as extremely serious and will result in an immediate termination of your account with no refund and/or a £500 fine per incident of spamming.

We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at our sole discretion and also reserve the right to make any such modifications in an emergency at our sole discretion.


Acceptable Use Policy
1. Web Threads reserves the right to suspend or cancel a customer's access to any or all services provided by Web Threads at any time without notice or reason. Web Threads also reserves the right to cancel or suspend a customer’s account if they breach this AUP.

2. You agree that you, as the person legally responsible for all use of this account, are at least 18 years of age. If you are under 18 years of age, you need to have parental consent in order to sign up, and the account must be ordered by a parent or guardian, in their own name. You agree to supply Web Threads with a current and truthful name, postal address, email address and telephone number for our records, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit card that you supply to us or our payment partner(s), and you understand and agree that we have an obligation to fully investigate any possible fraudulent credit card use.

Web Threads reserves the right to refuse service to anyone without notice or reason.

3. Sharing or Reselling of account
You are the individual solely responsible for all use of the account, whether someone you have given access to the account causes damage or not. You understand this includes but is not limited to; breach of the hosting account due to negligence on your part.

4. Account Setup
We will setup your account after we have received payment. It is your responsibility to provide an email address that is not on an account hosted by Web Threads.

5. Resource Usage
Users may not initiate the following:
 
 a) Run any process that requires more than 5Mb of memory space, more than 15 CPU seconds, or use more than 5% of all available system resources at any time.

 b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

 c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

 d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

 e) Run any process which interacts with the MySQL Database Management Server using persistent connections. The use of persistent connections to connect to the MySQL Database Management Server is strictly prohibited. Any account found to be in violation of this policy will be immediately suspended.

7. Account Use
Web Threads does not allow any of the following content to be hosted:

 a) Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any International, Federal, State or Local regulation.

 b) Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Web Threads.

 c) Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

 d) Other Material - Any material we feel to be abusive, effect or could effect the operation of the service and/or effect other internet users. The designation of "abusive" is left entirely to the discretion of Web Threads. All rights reserved.

 e) Shell (SSH) Access - A valid reason must be provided for this service to be enabled. Web Threads reserves the right to not enable it or disable it at anytime. Misuse (Spamming etc.) of this service may lead to a fine and/or legal action. This service is not enabled as default.

8. Mass-mailing lists
No account hosted on Web Threads servers may send in excess of one-hundred (100) emails per ten (10) minutes or one thousand (1000) emails per twenty-four (24) hours. Any account found in violation of this policy will be immediately suspended.

9. Backups and Data Loss
Your use of the service is at your sole risk. Web Threads is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data

Disclaimer of Warranty and Liability
WEBSITE HOSTING SERVICES PROVIDED BY Web Threads ARE ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. Web Threads DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE FOREGOING,
WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, Web Threads SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE
UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT. IN NO EVENT SHALL Web Threads BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF
PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER.
